Anti-Spam Policy

This Anti-Spam Policy forms an integral part of Trepup's (hereafter "Trepup", "we" or "us") policies which govern your access to and use of Trepup's products, including without limitation the use of the content on Trepup's website, products and services (collectively the "Products", each a "Product").

The use of our Products is also subject to our Terms of Service, the Commerce Policy and other policies. By using our Products, you (hereafter "User" or "you") agree to use them in accordance with the Terms and Policies.

Trepup conducts a zero-tolerance spam policy. Users are prohibited from sending unsolicited emails in any way while using our Products.

1. Legal framework

All Users are requested to comply with the following legislation relevant for commercial email service providers: CAN SPAM Act of 2003, Directive 2000/31/EC of the European Parliament and of the Council of 8 June 2000 on certain legal aspects of information society services, in particular electronic commerce, in the Internal Market ("Directive on electronic commerce"), Directive 2002/58/EC of the European Parliament and of the Council of 12 July 2002 concerning the processing of personal data and the protection of privacy in the electronic communications sector ("Directive on privacy and electronic communications") and all other applicable laws in the User’s country of residence.

2. What does spam mean?

"Spam" or "junk mail" stands for unsolicited, usually commercial email messages. Spam is irrelevant or unsolicited messages generally indiscriminately sent over the Internet, typically to many recipients, for the purposes of, among other things, advertising, phishing and spreading malware. "Unsolicited" means that the individual receiving the message has not requested or granted permission for sending such message. "Spamming" relates to providing, transferring or sharing unwanted email messages electronically, particularly on a large scale.

3. Conditions of use

You must obtain your contact's (hereafter "Contact") consent to processing their Personal Data (for further details concerning Personal Data, please refer to the Privacy Policy). It is illegal to send messages to any person without their express consent to receiving such information. Such consent must be explicitly provided on an informed basis and may not be presumed from statements of other content. Contacts may, at any time, withdraw their consent.

There are various possibilities to add Contacts to your account ("User Account"). For instance, email addresses can be manually added to create an electronic mailing list ("Contact List") or imported via your email service provider. You can also organize and manage your Contacts by creating a new or updating your existing Contact List.

Users are strictly prohibited from purchasing, leasing and/or renting email addresses from third parties, and from surreptitiously gathering them, e.g., by harvesting or scraping. The usage of scripts and software or automated solutions of any kind are strictly forbidden. Users may send electronic communication to and store or manage the data of such recipients who have provided their express consent only. Trepup reserves its right to carry out quality reviews of the Contact List with Contacts imported by the User and to adapt it where necessary.

Trepup does not have any direct relationship with your Contacts or other individuals you provide us information with. It is your sole responsibility to obtain the explicit consent of your Contacts regarding the use of our Products in accordance with applicable laws and regulations.

4. Message content

You are obliged to provide true and accurate information to be used in email newsletters, and sender and recipient details must be clearly identified in the "From" and "To" forms. The subject line must be clear and unambiguous for the Contact to comprehend the content and purpose of the email newsletter. The email newsletter may not contain any illegal or immoral content.

5. Postal address

Users must provide their true and accurate postal address by specifying their city and country which will be integrated in each email newsletter footer. Users are further responsible to maintain and always keep this data up to date to ensure it is complete, current and accurate.

6. Removal of contacts

Each email newsletter sent from a User Account contains a non-removable unsubscribe link. This link automatically updates the Contact List to make sure that a Contact having opted out will not be provided with any further email newsletters.

You are prohibited from sending email newsletters to any individual that had been added to your Contact List but unsubscribed from it at a later stage. An overview of Contacts that have unsubscribed shall be provided in the User Account.

7. Violations

You are prohibited from using the Products to send any unsolicited or unwanted email correspondence.

Should you be found spamming or using our Products for any other illegal or abusive purposes, Trepup will take appropriate actions, such as terminating your User Account without notification and/or reporting you and the incident to the respective Internet Service Provider and proper authorities, with or without notice, at our sole discretion and subject to mandatory provisions of law. Without limitation to the foregoing, you are solely liable for any loss incurred or damage suffered by Trepup or any third party if such loss results from violating this Anti-Spam Policy.

8. How are changes to this Anti-Spam Policy made?

We may update this Anti-Spam Policy from time to time, and if we do, we will post any changes on this page. If we believe that a revision is material, we may notify you. We further reserve the right to determine the most appropriate manner of providing notifications to you, and you agree to receive notices electronically if we so choose. You are advised to review this Anti-Spam Policy periodically. Your continued access or use of Trepup once a revision becomes effective will mean that you accept the revised Anti-Spam Policy and agree to be bound by such Anti-Spam Policy. If you do not agree to the revised Anti-Spam Policy, please stop using our Products.
