Spam

This Spam policy governs the sending of any irrelevant or unsolicited messages to contacts by using Trepup for the purposes of, among other things, advertising, phishing, and spreading malware to contacts who have not granted their permission for receiving such communications. This policy will be applicable to you and your contacts for any electronic communication sent by you through Trepup.

The policy should be read in conjunction and together with the Terms of Service and the Policies. For the purposes of this policy, all capitalized terms, not otherwise defined herein, shall have the meaning ascribed to them as set forth in the Terms of Service.

All references in this policy to the singular shall include the plural (and vice versa) where applicable, and any gender form shall include all others.

User obligations

While using Trepup, you will not

  • send spam through Trepup.
  • violate, or facilitate a violation of, the Privacy Notice, Cookies policy, any other Policies, or applicable spamming laws.
  • pretend that you are, or that you represent, someone else, or impersonate any other individual or entity without their consent.
  • purchase, lease, or rent email addresses from third parties as a part of a distribution list.

You must ensure that while using Trepup, you will

  • employ reasonable efforts to prevent unauthorized access to or unauthorized use of Trepup.
  • notify us if you have any knowledge of such unauthorized access or use, or attempt thereof, of Trepup.
  • keep your Trepup Account updated and respond promptly to any communication between you and our support staff, which may be used for monitoring and quality improvement.
  • obtain consent and allow provision for withdrawal of consent while sending electronic communication, in addition to storing or managing data of your contacts.
  • provide an easily accessible mechanism to revoke consent or unsubscribe from your electronic communication at any time through an unsubscribe option.
  • immediately honor any opting out of receiving your electronic communication.
  • provide clear and complete details of your identity and contact address including your email address in any electronic communication with third parties.
  • ensure that the communication and/or user content in the electronic communication is in accordance with the User Generated Content policy, the Policies, and applicable law.

Personal data

You are responsible for the nature and content of all data uploaded on Trepup, including personal data of your contacts or third parties. If you upload such personal data, you must ensure compliance with the Privacy Notice and applicable law including, without limitation, the GDPR as may be applicable. In the event you fail to comply with applicable law, you must delete the personal data from Trepup. In the event of a change in the applicable data protection laws, you agree that you will cooperate with us to ensure that all personal data is collected and processed in compliance with such changes.

Trepup’s rights

We reserve the right to

  • monitor any Trepup Account or user content, without notice, including for discharge of legal obligations, as may be applicable.
  • disclose communications between you and your contacts, without notice, to third parties in compliance with a legal obligation, including, for the purposes of responding to requests from law enforcement agencies.
  • classify your Trepup Account as inactive in the event you do not sign in to your Trepup Account for more than 180 calendar days.
  • deactivate, temporarily suspend or terminate your Trepup Account for violating this policy, the Policies, or applicable law.

We will determine if you have sent spam by reviewing and monitoring

  • your user content.
  • complaints of spam by your contacts.
  • the complaint rate.
  • the total number of complaints, regardless of the complaint rate.
